Data protection information in connection with our webshop

1         In a nutshell

We, Press Parts Outlet GmbH, Karl-Farkas-Gasse 22, 1030 Vienna, FN 265330 t process your personal data within the scope of your use of our webshop. We treat the data entrusted to us strictly confidential and handle your personal data with care. The processing of your personal data takes place exclusively in accordance with the provisions of the General Data Protection Regulation ("GDPR") and the Austrian Data Protection Act, all being applied in their up-to-date versions.

Because we are aware of the importance of your personal data, we will inform you hereinafter how we process your personal data ("your data"). This Privacy Policy is regularly updated due to legal or technical developments. If you have any questions in this regard, please contact us via the contact details as provided to you in Section 2 of this Privacy Policy.

2         Who is responsible for processing your data?

Press Parts Outlet GmbH, Karl-Farkas-Gasse 22, 1030 Vienna (FN 265330 t) is responsible for the data processing activities as outlined in this Privacy Policy and thus, Press Parts Outlet GmbH is the Controller according to the GDPR. 3         What information do we process?

For technical reasons, certain data must be collected and stored when you visit our web pages, such as the date and duration of your visit, the web pages used, the identification data of the type of browser and operating system used and the website from which you are visiting us.

"Personal data" means any information relating either directly or indirectly to natural persons. This includes in particular your name, date of birth, address, telephone number, e-mail address, but also your IP address if you place an order in our webshop. There is no restriction on the use of non-personal data because in these cases it is no longer possible to trace the data back to specific individuals (anonymous data, such as aggregated data of a group).

We process the personal data that you make available to us as a user of the webshop, e.g. during your registration processor when you place an order. These are the following information:

Personal data: first name and surname;

Contact details: e-mail address, address, IP address, company name, VAT number, telephone number, e-mail notifications enabled/disabled

Registration data: registration date, customer number; VAT number

Usage data: bank, credit and payment data, purchased items, preferences, time and code of a redeemed coupon, order history, evaluations submitted; correspondence data (e.g. in the case of complaints/returns);

In order to fulfill a contract, we require certain personal data from you. This data is required to make bookings in the eShop, process payments, carry out credit checks, deliver to the specified address (if items are to be shipped) and, where appropriate, to process cancellations or refunds.

In this case, the contract is the legal basis for the processing of your personal data in accordance with Art. 6 para. 1 lit. b GDPR. Art. 6 para. 1 lit. b GDPR also applies in respect of processing operations that are necessary for carrying out pre-contractual measures, for example in the event of inquiries regarding our products or services.

If we obtain your consent for the processing of personal data (for example, if you sign up for the newsletter or use the “stay signed in” option), this serves as the legal basis in accordance with Art. 6 para. 1 lit. a GDPR.

If our company is subject to a legal obligation rendering the processing of personal data necessary, for example in order to meet tax obligations, the processing is based on Art. 6 para. 1 lit. c GDPR.

In order to constantly improve the services we offer you, we store and analyze usage data from the online area on a pseudonymized basis. The legal basis for this is our legitimate interest in the optimization of our web pages and apps, and in the effective design of our advertising in accordance with Art. 6 para. 1 lit. f GDPR.

Only applies to existing customers: We are also interested in maintaining our customer relationship with you and in providing you with information and offerings that we believe match your interests. We therefore process your data on the basis of Art. 6 para. 1 lit. f GDPR (also with the help of service providers) in order to send you information and offerings. We use your contact data (name and e-mail address that we have received from our business relationship with you) for advertising by post and for market research, unless you object to such use.

 

4         What are the purposes for which we process your personal data and on what legal grounds do we do so?

4.1     Purposes of data processing

The data processing takes place for the following purposes (the "purposes"):

  1. to provide your webshop access;
  2. for the performance of contracts and for the pre-contractual treatment of your inquiries;
  3. to set up and implement the customer loyalty program;
  4. for complaint management reasons;
  5. to compile statistics on the purchasing behavior of our customers;
  6. if the processing of your data is necessary for the technical implementation of the system, exclusively for reasons of system security, system stability or troubleshooting;
  7. to fulfill legal or official requirements as well as
  8. to assert, exercise or defend legal claims.

4.2     Legal basis :

  • Performance of contract according to Art. 6 para. 1 lit. b GDPR

The processing of your personal data for the purpose of (1) providing the webshop, (2) performing the contract, including any pre-contractual processing of your inquiry, and data processing for the purpose of (4) complaint management (if, e.g., it involves reverse transactions, or notification of defects) is carried out on the legal basis of contract fulfillment, if and to the extent that data processing is necessary for the fulfillment of our (pre)contractual obligations.

  • Legitimate interest according to Art. 6 par. 1 lit. f GDPR

Data processing for (3) setting up and implementing the customer loyalty program; as well as for (2) complaint management, if you address suggestions and complaints to us beyond the aforementioned extent, for (5) compiling statistics on the purchasing behavior of our customers, (6) if the processing of your data is necessary for the technical implementation of the system, exclusively for reasons of system security, system stability or troubleshooting, and (8) for asserting, exercising or defending legal claims, we see in our legitimate interest. In particular, we assume on the basis of your registration in our webshop that you are interested in the products offered by us and that you wish to place an order in our webshop. The data is protected from unauthorized access by (encrypted transmission, pseudonymization of data, role authorization concept, data security concept, reliability). The security measures are continuously revised in line with technological developments.

Our legitimate interest follows from the data collection purposes listed above. In the sense of a balancing our interests with your secrecy interests according to Art. 6 para. 1 lit. f GPR, we consider your secrecy interests in connection with the processing activities listed under Section 3 and in data made available by you for using our webshop as not overriding. You have the right to object to such data processing under the conditions of Art 21 GDPR. You can find further information on exercising this right under Section 7 "your rights".

4.2     Compliance with an obligation according to Art. 6 (1) (c) GDPR

Like any company, we are subject to legal obligations that may require us to process personal data (7). Such obligations may arise, for example, from tax or data protection obligations.

5          To whom do we transfer your data?

We use the aforementioned data, which you have provided to us as a user of the webshop, only for the above-mentioned purposes. Data will only be transferred by us to third parties if this is necessary for the purpose of processing the contract, at the request of domestic authorities or on the basis of court decisions. A transfer for the purpose of fulfilling the contract, for example, concerns our transfer of data to a server or to companies that process your data on our behalf (our data processors). Our contractual partners are contractually obliged to comply with the highest data protection standards.

In particular, your data will be transferred to our data processor Shopify International Limited, 2nd Floor 1-2 Victoria Buildings, Haddington Road, Dublin 4, D04 XN32, Irland and Shopify Inc., 150 Elgin Street, Suite 800, Ottawa, ON K2P 1L4, Canada, in the course of a purchase in our webshop. Shopify Inc.is located in a country that has a so-called European Union adequacy decision and thus, it is located in a country with similar data protection standards than those we have to ensure in Austria. Shopify International Limited and Shopify Inc. may use affiliates as sub-processors to perform its services (to provide the webshop). In all cases where (sub)processors located outside the territory of the European Union are engaged, we ensure that the European data protection level and European data security standards are maintained. Shopify Inc.'s US affiliates have an established EU-U.S. Privacy Shield certification.

6          How long is your data stored?

We store data as long as you are registered as a user of our webshop. In addition, data will only be stored to the extent required by law (e.g. due to warranty, limitation and retention periods) or otherwise required.

Data will be deleted if (a) the data is no longer required for the fulfilment of the user contract regarding the webshop, or (b) storage is or becomes inadmissible for other legal reasons. 7          What rights do you have and how can you exercise them?

In order to exercise your rights under the above points, please send a request to info@press-parts-outlet.com or to the postal address indicated in the imprint.

You have the right to receive information on whether personal data relating to you are being processed and further information on this data. This information relates, among other things, to the processing purposes, categories of data, potential recipients or duration of storage.

You have the right to request the correction of any incorrect personal data concerning you. If the data processed by us is not correct, we will correct it immediately and inform you.

In the event that you no longer wish your data to be processed by us, please inform us accordingly. We will of course delete the data immediately and inform you, unless compelling legal reasons or our overriding legitimate interests prevent a deletion. In the latter cases, we will inform you immediately.

You have the right to ask for a restriction of the processing of your data in the following cases:

  • In the case of a request for correction, if you so request;
  • if you are of the opinion that data processing is unlawful but do not wish the data to be deleted;
  • if you still need the data in connection with legal claims; or
  • if you have objected to the processing.

Under specific circumstances, you may have the right to receive your data in a structured, common and machine-readable format and to have the data transferred directly by us to another data protection officer.

Even if your data is correct and complete and is lawfully processed by us, you may object to the processing of this data in specific exceptional cases which have to be justified by you. You are entitled to this right of objection under the conditions of Art 21 GDPR, i.e. in the case of data processing carried out in our legitimate interest. You can also object if you receive direct advertising from us and no longer wish to receive it in the future.

If we process your data in the future on the basis of your consent, you have the right to revoke your consent to the processing of your data at any time with effect for the future. This does not affect the legitimacy of the processing of the data, which took place on the basis of the consent, up to the time of the revocation.

You have the right to lodge a complaint with the data protection authority if you are of the opinion that the processing of your data violates applicable law, in particular the GDPR.

8          Cookies

Our webshop uses so-called cookies. These are small text files that are stored on your device with the help of the browser. They do not cause any damage. We use cookies to make our website user-friendly. They enable us to recognize your browser the next time you visit. In our webshop cookies are used by our data processor in order to be able to assign your orders to your shopping basket even before completing a purchase. If you do not wish to receive cookies, you can set your browser so that it informs you when cookies are set and only allows you to do so in individual cases.     Google Analytics uses cookies. Those Cookies generate information (including your IP address) about your use of our website and transmit and store this information on Google servers located in the USA. We use the "IP anonymization" function of Google Analytics. With this function, your IP address is truncated within the European Union and only transmitted to servers in the USA after anonymization. Only in exceptional cases (e.g. if the EU-based systems fail) the entire IP address is transmitted to a Google’s servers in the USA and are truncated there.

    Google uses the information obtained through these cookies to evaluate your usage behaviour on this website, to provide us with reports of your website activities and to provide us with further services associated with the use of the website. Google may also transfer this information to other recipients where required by law, or where such service providers process the information on Google's behalf.     We store the data on pseudonymized profiles that cannot be associated with any individual person for a period of 26 months to prevent cases of abuse and to optimize our web pages.     Google Analytics Advertising Feature

    With your consent under Art. 6 para. 1 lit. a GDPR, we use Google Analytics advertising features on our web pages. This enables us to display personal offers to you, including outside the websites hosted by Press Parts Outlet GmbH.

    Shopify Fraud analysis indicators (Fraud analysis · Shopify Help Center)

    We are using Shopify's fraud analysis which provides indicators for each order. Our legal basis for this process The indicators can include information such as:

    • Whether the credit card used for the order passes AVS checks
    • Whether the customer provided the correct CVV code
    • Details about the IP address used to place the order
    • Whether the customer tried to use more than one credit card.
    • Card Verification Value CVV is correct,
    • Billing street address matches credit card´s registered address,
    • Billing address ZIP or postal code matches the credit card´s registered address
    • There was 1 payment attempt, Payment was made with 1 credit card
    • Billing country matches the country from which the order was placed
    • Shipping address is 520km from location of IP address 

     

    Google Tag Manager

    We use Google Tag Manager. The provider of the Google Tag Manager component is Alphabet Inc. This service enables website tags to be managed via an API. Google Tag Manager only implements tags. This means that cookies are not used and no personal data is collected. Google Tag Manager triggers other tags that can be used to collect data, however, Google Tag Manager does not access this data. If deactivation has been carried out at domain or cookie level, this will remain in place for all tracking tags implemented with Google Tag Manager.

     Payment via PayPal

    When paying via PayPal, we pass on your payment data to PayPal (Europe) S.a.r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter "PayPal") as part of the payment processing. The transfer takes place in accordance with Art. 6 Para. 1 lit. b DSGVO and only insofar as this is necessary for the payment processing. For the payment methods credit card via PayPal, direct debit via PayPal or - if offered - "purchase on account" or "payment by instalments" via PayPal, PayPal reserves the right to carry out a credit check. For this purpose, your payment data may be passed on to credit agencies in accordance with Art. 6 Para. 1 lit. f DSGVO on the basis of PayPal's legitimate interest in determining your solvency. PayPal uses the result of the credit check in terms of the statistical probability of non-payment for the purpose of deciding on the provision of the respective payment method. The creditworthiness information may contain probability values (so-called score values). In so far as score values are included in the result of the credit report, they have their basis in a scientifically recognised mathematical-statistical procedure. The calculation of the score values includes, but is not limited to, address data.     You can object to this processing of your data at any time by sending a message to PayPal. However, PayPal may still be entitled to process your personal data if this is necessary for the contractual processing of payments.

     

    reCAPTCHA

    This service (e.g. for contact forms, and newsletter registrations) is used for purposes of identification and to prevent the services provided from being misused by machines. “Captchas” are generated and verified on application servers from Press Parts Outlet. No data is transmitted to third parties in the process. Legal Basis for the usage of reCAPTCHA is our legitimate interest according with Art. 6 para. 1 p. 1 lit. f GDPR to protect the website from abusive automated spying and from spam.
